DISTANCE CONTRACT

This distance contract (hereinafter referred to as the Contract) is concluded between "SUNNY FACTORY" Ltd, registration number LV40103269333,  legal address: Latgales street 222 - 10, Rīga, LV-1019, Latvia, the owner of the online trading platform www.saulesriga.com, (hereinafter referred to as the Seller), and a buyer who is not younger than 14 years old (hereinafter referred to as the Buyer), who places an order and executes a purchase on the website www.saulesriga.com. The distance contract applies to all orders and purchases made on the website www.saulesriga.com (hereinafter referred to as the SAULESRIGA website).

1. General Terms and Conditions

1.1. The Buyer orders, purchases and pays, and the Seller delivers and sells body cosmetics, products for bath, other cosmetics, and goods (hereinafter referred to as the Product) in accordance with the terms of this Agreement.

1.2. The Buyer purchases the Product by filling out the appropriate order form on the SAULESRIGA website. When placing an order, the Buyer undertakes to provide true and complete information, namely their name, delivery address and contact details. The Buyer undertakes to notify the Seller of any changes no later than 24 hours after receiving the order confirmation by writing to info@saulesfabrika.com. The Buyer bears responsibility for providing correct details, otherwise delivery of the Product may be delayed or considered impossible.

1.3. A purchase order is the Buyer’s offer to the Seller to conclude the Contract for the supply of the Product and the Buyer’s agreement to purchase the ordered Product at the specified price.

By placing an order, the Buyer confirms that he has read, understood, and agrees with the terms of the Contract and undertakes to comply with them. The Buyer has no right to place orders unless he has read and agreed to the terms of the Contract. The Contract is drawn up in accordance with the regulations of the Republic of Latvia.

1.4. The Contract comes into force on November 1, 2023.
 

2. Product Price and Delivery Fees

2.1. Prices for the Products on the SAULESRIGA website are indicated in Euro currency. All prices include value added tax and other taxes. Products are sold at prices which are in effect at the time of ordering. Total shipping cost may include additional fees. Depending on the bank or payment method used by the Buyer, bank fees may be applied.

2.2. The Buyer shall make the payment for the Product in the online store www.saulesriga.com by debit or credit card (MasterCard, Visa), PayPal or transfer through online banking. All shipping costs shall be paid by the Buyer.

2.3. The Seller shall deliver the Product to the address specified by the Buyer in accordance with the tariffs established by the courier. The Buyer is obliged to pay the shipping costs together with the price for the ordered Goods before receiving confirmation about the delivery of the Goods from the Seller. Shipping costs are included in the Invoice. An electronic document serving as the payment basis – e-invoice is valid without a signature.

2.4. The Buyer can place orders 24 hours per day, the Seller shall send the Buyer confirmation of the order acceptance by email. If the Buyer does not receive a confirmation email, the order will not be considered accepted. The order fulfillment begins from the moment the money is credited to the Seller’s bank account.

2.5. Information on the estimated delivery time is provided when the order has been placed.
 

3. Quality Guarantee and Responsibilities

3.1. SAULESRIGA does not bear any responsibility and does not guarantee that the product will always meet the Buyer's expectations beyond what is stated in the Product description. If the Buyer is not satisfied with the quality of the product, the Buyer, upon receipt of the order, has the right to return the specific product and receive a full refund for the product.

3.2. The Product received may vary slightly in size, shape and colour from those shown on the SAULESRIGA website.

3.3. The features and instructions for the use of all the products sold on the SAULESRIGA website are specified in the product description attached to each product.
 

4. Right of Returning and Rejecting the Purchase

4.1. The Buyer may exercise the right of rejecting a purchase order under the Law on the Protection of Consumer Rights of the Republic of Latvia and return the Product within 14 calendar days.

4.2. If an order is incorrectly fulfilled, the Buyer has the right to demand a replace of the Product within 14 days by sending a request to info@saulesfabrika.com. In this case, the Seller undertakes to bear the costs of the delivery.

4.3. If the Buyer wishes to exercise the right of returning, the following recommendations and conditions must be satisfied:

4.4. The returned Product must be unused. If the returned Product has been damaged due to improper storage, the Buyer does not have the right to exercise the right of returning.

4.5. The Buyer is obliged to keep the original packaging of the Product intact.

4.6. The buyer may request a refund or replacement of goods by sending an email to info@saulesfabrika.com. In the email message, the Buyer shall indicate the reason for returning or request for the product replacement, as well as their name, address and telephone number.

4.7. The Buyer undertakes to retain both, the documents for the receipt of the Product and the shipping documents for returning the Product to the Seller.

4.9. The money shall be reimbursed to the Buyer no later than 14 days after "Sunny Factory" Ltd receives the returned product and recognizes it as unused and undamaged.

4.10. The Buyer's rights in the event of non-conforming goods:

4.11. Defects of the Product shall be fixed, while the non-conforming Product shall be replaced or returned as stipulated in the Contract provisions and in accordance with the requirements of the Current Legislation of the Republic of Latvia;

4.12. The Buyer willing to file a complaint about inadequate quality or the incorrectly packaged Product can do so by sending an email to: info@saulesfabrika.com,  and can return the non-conforming Product;

4.13. When filing a complaint, the Buyer must provide the following information:

4.14. Invoice and order number. If possible, the Buyer must attach an invoice so that the Seller can process the Buyer's complaint in a shortest possible time;

4.15. The Product defects, damage or missing parts must be specified;

4.16. The Buyer must provide other proof, such as an image of the defective Product, an image of the part of ​​the Product of inadequate quality (provided it is a mechanical damage and can be photographed), an image of the packaging, etc.

4.17. When filing a complaint, the Buyer initially has the right to demand that the Seller fix free of charge the non-conforming Product or replace it by the Product which quality comply with the terms of the Contract, except the cases when this is deemed impossible or disproportionate (Article 28 of the Law on the Protection of Consumer Rights, Part Two) .

4.18. A response to the complaint shall be sent within 14 days from the date of the receipt of the complaint. If, for objective reasons, it is not possible to give a response to the Buyer’s complaint within the specified period, the Seller shall immediately inform the Buyer in writing, indicating a reasonable period within which the response will be given, as well as the justification for such a delay.

4.19. Only if the Seller accepts that the Product is indeed lacks adequate quality, the Buyer’s complaint regarding the Product inadequate quality can be satisfied. The Seller shall refund the payment to the bank account which was used for placing the order. The Seller reserves the right to demand the Buyer to return the damaged Product to the store.

6. Final Terms and Dispute Resolution

6.1. In the event of a breach by the Seller of this Contract, the Seller shall be liable only for direct losses to the Buyer resulting from a direct breach.

6.2. The Seller has the right to fully modify the Contract or partially terminate the operation of the SAULESRIGA website.

6.3. The Contract is considered valid until all the obligations between the Seller and the Buyer are fulfilled.

6.4. The Contract is drawn up in accordance with the laws of the country from which the service is provided to the Buyer; all disputes arising out of or relating to the Contract shall be resolved in the court of law, established by the laws of the jurisdiction in which the Seller’s company involved in the dispute is located.

6.5. The Seller reserves the right to block the Buyer from making purchases on the SAULESRIGA website for a limited or unlimited period provided dishonest actions are detected, or facts about previous dishonest actions of a particular person on the SAULESRIGA website are revealed. Dishonest actions are considered acts related to fraud, as well as other acts that may disrupt or harm the Seller’s or the SAULESRIGA website’s operations, and/or lead to direct or indirect losses.

6.6. Disputes between the Buyer and the Seller shall be resolved through mutual negotiations. If the Seller and the Buyer fail to resolve the dispute through negotiations, the Buyer may file a complaint with the Commission for Out-of-Judicial Resolution of Consumer Disputes, which is located at Brivibas Str. 55, Riga, Latvia, LV-1010 (more details information on dispute resolution is available on the website www.ptac.gov.lv) or go to the court. In addition to the above, the Buyer may use the Online Dispute Resolution (ODR) platform to resolve disputes regarding the goods or services purchased on the site. 7. Processing of personal data

7.1. The Buyer’s personal data shall be used to identify the Buyer, receive orders, place and deliver orders, prepare accounting documents, including invoices, refund overpaid sums and send refunds for returned goods, administer financial and other obligations arising from the Contract and other cooperation, as well as other documents related to cooperation between the parties, and also to use the services offered on the SAULESRIGA website.
